General Terms and Conditions of Sisi Living

1. General provisions
1.1 These general terms and conditions apply to all agreements between Sisi Living and its customers.
1.2 By placing an order with Sisi Living, the customer agrees to these general terms and conditions.
2. Product information
2.1 Sisi Living strives to provide accurate and complete information about the home accessories offered, including prices, features and availability.
2.2 Sisi Living reserves the right to change the range at any time and to correct any errors in the product information.
3. Ordering process
3.1 An agreement between the customer and Sisi Living is concluded after confirmation of the order by the webshop.
3.2 The customer will receive an order confirmation by e-mail containing the details of the order.
3.3 Items in the shopping cart are not reserved. It is therefore possible that if another person has the same item in his/her shopping cart and pays for it earlier, it will be marked as sold out to you.
4. Right of withdrawal
Right of withdrawal Upon delivery of products:
4.1. When purchasing products, the consumer has the option to terminate the agreement without giving reasons within 14 days. This reflection period starts on the day after receipt of the product by the consumer or a representative designated in advance by the consumer and made known to the entrepreneur.
4.2. During the cooling-off period, the consumer will handle the product and packaging with care. He will only unpack or use the product to the extent necessary to assess whether he wishes to keep the product. If he exercises his right of withdrawal, he will return the product to the entrepreneur with all accessories supplied and - if reasonably possible - in the original condition and packaging, in accordance with the reasonable and clear instructions provided by the entrepreneur.
4.3. If the consumer wishes to exercise his right of withdrawal, he is obliged to inform the entrepreneur of this within 14 days of receipt of the product. The consumer must make this known using the model form or by means of another means of communication such as by e-mail. After the consumer has indicated that he wishes to exercise his right of withdrawal, the customer must return the product within 14 days. The consumer must prove that the delivered goods have been returned on time, for example by means of proof of shipment.
4.4. If, after the expiry of the periods referred to in paragraphs 2 and 3, the customer has not indicated that he wishes to exercise his right of withdrawal or has not returned the product to the entrepreneur, the purchase is a fact. When providing services: 1. When providing services, the consumer has the option to terminate the agreement without giving reasons for at least 14 days, starting on the day of entering into the agreement. 2. To exercise his right of withdrawal, the consumer will follow the reasonable and clear instructions provided by the entrepreneur with the offer and/or at the latest upon delivery.
4.5. If the consumer exercises his right of withdrawal, a maximum of the costs of return will be borne by him.
4.6. If the consumer has paid an amount, the entrepreneur will refund this amount as soon as possible, but no later than within 14 days after cancellation. This is subject to the condition that the product has already been received back by the online retailer or that conclusive proof of complete return can be provided. Refunds will be made via the same payment method used by the consumer unless the consumer expressly consents to a different payment method.
4.7. If the product is damaged due to careless handling by the consumer himself, the consumer is liable for any reduction in value of the product.
4.8. The consumer cannot be held liable for depreciation of the product if the entrepreneur has not provided all legally required information about the right of withdrawal, this must be done before concluding the purchase agreement.
4.9. The entrepreneur can exclude the consumer's right of withdrawal for products as described in paragraphs 2 and 3. The exclusion of the right of withdrawal only applies if the entrepreneur has clearly stated this in the offer, at least in time before concluding the agreement.
4.10 Exclusion of the right of withdrawal is only possible for products: which have been created by the entrepreneur in accordance with the consumer's specifications; that are clearly personal in nature; which by their nature cannot be returned; that can spoil or age quickly; the price of which is subject to fluctuations in the financial market over which the entrepreneur has no influence; for individual newspapers and magazines; for audio and video recordings and computer software of which the consumer has broken the seal; for hygienic products of which the consumer has broken the seal.
4.11. Exclusion of the right of withdrawal is only possible for services: relating to accommodation, transport, restaurant business or leisure activities to be provided on a certain date or during a certain period; the delivery of which has started with the express consent of the consumer before the cooling-off period has expired; regarding betting and lotteries.
5. Prices and payment
5.1 All prices on the webshop are stated in euros and include VAT, unless stated otherwise.
5.2 Any additional costs, such as shipping costs, will be clearly displayed during the ordering process.
5.3 Payment can be made via the payment methods stated in the webshop.
6. Delivery
6.1 Sisi Living strives to ship orders within the stated delivery times.
6.2 The customer is responsible for providing the correct delivery address. Additional costs resulting from incorrect address information will be borne by the customer.
7. Complaints and warranty
7.1 Complaints about the performance of the agreement must be submitted fully and clearly described to the entrepreneur within 2 months after the consumer has discovered the defects.< /p>
7.2 We do not guarantee any type of printing or stickers.
7.3. The entrepreneur has a sufficiently publicized complaints procedure and handles the complaint in accordance with this complaints procedure.
7.4. Complaints submitted to the entrepreneur will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeably longer processing time, the entrepreneur will respond within 14 days with an acknowledgment of receipt and an indication of when the consumer can expect a more detailed answer.
7.5. If the complaint cannot be resolved by mutual agreement, a dispute arises that is subject to the dispute settlement procedure.
7.6. In case of complaints, a consumer must first contact the entrepreneur. If the online store is affiliated with WebwinkelKeur and for complaints that cannot be resolved by mutual agreement, the consumer must contact WebwinkelKeur (www.webwinkelkeur.nl), who will mediate free of charge. Check whether this online store has a current membership via https://www.webwinkelkeur.nl/ledenlijst/. If a solution is not yet found, the consumer has the option to have his complaint handled by the independent dispute committee appointed by WebwinkelKeur, the decision of which is binding and both the entrepreneur and the consumer agree to this binding decision. Submitting a dispute to this dispute committee involves costs that must be paid by the consumer to the relevant committee. It is also possible to register complaints via the European ODR platform (http://ec.europa.eu/odr).
7.7. A complaint does not suspend the obligations of the entrepreneur, unless the entrepreneur indicates otherwise in writing.
7.8. If a complaint is found to be justified by the entrepreneur, the entrepreneur will, at his option, replace or repair the delivered products free of charge.
8. Disputes
8.1. Agreements between the entrepreneur and the consumer to which these general terms and conditions apply are exclusively governed by Dutch law. Even if the consumer lives abroad.
8.2. The Vienna Sales Convention does not apply.
9. Liability
9.1 Sisi Living's liability is limited to the amount covered by the liability insurance in the relevant case.
9.2 Sisi Living is not liable for indirect damage, including consequential damage, lost profits, or damage as a result of business stagnation.
10. Intellectual property
10.1 All intellectual property rights on the website and its content belong to the webshop.
10.2 The customer is not permitted to copy, reproduce or otherwise use content and images without written permission from the webshop.
11. Governing Law and Dispute Resolution
11.1 Dutch law applies to all agreements.
11.2 Disputes will, if possible, be resolved by mutual agreement. We will always do our best to achieve this.
12. Changes to the terms
12.1 Sisi Living reserves the right to change these terms and conditions at any time. Customers will be notified of changes.
